Welcome to Novaxa Nutrition (“Novaxa,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, subscriptions, and any content provided by Novaxa (collectively, the “Services”). By accessing or using the Services, creating an account, or purchasing our products, you acknowledge that you have read, understood, and agree to be bound by these Terms and our accompanying policies, including our Privacy Policy, Payment Policy, Shipping Policy, and Refund & Return Policy (collectively, the “Policies”). If you do not agree, do not use the Services.
Supplement & Health Disclaimer: Novaxa products are dietary supplements. They are not intended to diagnose, treat, cure, or prevent any disease. Always consult a qualified healthcare professional before using any supplement, particularly if you are pregnant, nursing, have a medical condition, or are taking medications.
1) Eligibility & Account Registration
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services or purchase products. By using the Services, you represent and warrant that you meet this requirement and that the information you provide to Novaxa is accurate, complete, and up to date.
If you create a Novaxa account, you are responsible for:

Maintaining the confidentiality of your login credentials;

All activities that occur under your account.

2) Orders, Acceptance & Availability
All orders placed through our website are offers to purchase products under these Terms. We may accept, decline, or place limitations on any order at our sole discretion, including for suspected fraud, pricing errors, supply constraints, or violations of these Terms.

Order Confirmation: After checkout, you will receive an order confirmation email acknowledging receipt of your order. This does not guarantee acceptance.

Acceptance: An order is accepted when we dispatch the product and send a shipping confirmation.

Quantity Limits: We reserve the right to limit or cancel quantities purchased per person, household, or order.
3) Pricing, Payments & Taxes
Prices are displayed in the currency shown at checkout and may change at any time without notice. The price confirmed at checkout is the price you pay for that order.

Promotions: Discounts and promo codes may be subject to restrictions and cannot be applied retroactively unless stated.
In the event of a pricing or listing error, we may cancel or adjust your order and will notify you promptly.
4) Shipping, Risk of Loss & Title
Shipping options, timelines, and restrictions are described in our Shipping Policy. Title and risk of loss transfer to you when the carrier accepts the shipment. We are not responsible for delays caused by carriers, weather, customs, or events beyond our control. If your package is lost, damaged, or stolen, contact us and we will assist per our policies.
5) Returns, Refunds & Exchanges
Our Refund & Return Policy governs eligibility, timing, and procedures. Because our products are ingestible, except where required by law or in the event of verified damage/defect. Unopened, sealed products may be eligible for return within the stated window. Follow the RMA instructions provided by our support team before sending anything back.
6) Health Information & No Medical Advice
Content on our website—including blog posts, product pages, FAQs, and marketing materials—is provided for informational purposes only and should not substitute professional medical advice, diagnosis, or treatment. Always read labels and follow usage directions. Discontinue use and consult a physician if you experience any adverse reaction.
7) Intellectual Property
All content on the Services—including text, graphics, logos, product names, icons, images, videos, audio clips, digital downloads, data compilations, and software—is the property of Novaxa or its licensors and protected by intellectual property laws. 8) User Content: Reviews & Submissions
You may be able to post reviews, feedback, photos, or other content (“User Content”). By submitting User Content, you represent and warrant that you own or have necessary rights to publish it and that it:

Does not infringe any third-party intellectual property, privacy, or publicity rights;

Is not defamatory, obscene, harassing, hateful, or unlawful; and

Contains no viruses, malware, or harmful code.
By posting User Content, you grant Novaxa a perpetual, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, modify, publish, translate, distribute, display, and create derivative works from that content in any media for marketing and operational purposes. We may remove or edit User Content for any reason.
9) Prohibited Uses
You agree not to misuse the Services. Prohibited conduct includes, but is not limited to:

Violating any applicable law or regulation;

Attempting to gain unauthorized access to systems or data;

Interfering with security features or site integrity;

Using bots, scrapers, or automated means to access the Services without permission;

Engaging in fraudulent orders, chargeback abuse, or coupon misuse;

We may suspend or terminate access for violations, investigate suspected violations, and cooperate with law enforcement as required.
10) Third-Party Services & Links

Novaxa does not control and is not responsible for third-party content, policies, or practices. Use third-party services at your own risk and review their terms and privacy policies.
11) Subscriptions & Auto-Renewals (If Offered)
If you enroll in a subscription, you authorize recurring charges to your selected payment method at the interval shown at checkout until you cancel. You can manage or cancel your subscription via your account or by contacting support at least 48 hours before the next billing date. Price changes for subscriptions will be communicated in advance; continued use constitutes acceptance.
12) Disclaimers of Warranties
To the maximum extent permitted by law, the Services and all products are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not guarantee specific results from use of our products.
Some jurisdictions do not allow limitations on implied warranties; the above may not apply to you to the extent prohibited by law.
13) Limitation of Liability
To the maximum extent permitted by law, in no event shall Novaxa, its officers, employees, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages (including lost profits, lost data, business interruption, personal injury, or property damage) arising out of or related to your use of or inability to use the Services or products, even if advised of the possibility of such damages.
Our aggregate liability to you for direct damages shall not exceed the greater of (a) the total amount paid by you to Novaxa for the product(s) at issue in the six months preceding the claim, or (b) USD $100. Some jurisdictions do not allow certain limitations; some of the above may not apply to you.
14) Indemnification
You agree to indemnify, defend, and hold harmless Novaxa and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your misuse of the Services or products; (b) your violation of these Terms or applicable law; or (c) your User Content.
15) Dispute Resolution, Governing Law & Venue
We aim to resolve concerns quickly and fairly. Please contact    Support@thenovaxa.com before pursuing formal action.

18) Severability, Waiver & Entire Agreement
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force. Our failure to enforce any right or provision is not a waiver of such right or provision. These Terms, together with the Policies, constitute the entire agreement between you and Novaxa regarding the Services and supersede all prior agreements or understandings.
